NORTH MIAMI BEACH, Fla. \u2014 A North Miami Beach woman called the police on her husband Sunday night after witnessing him raping her \u201casleep and unresponsive\u201d friend who was visiting from overseas, according to an arrest report.<\/p>\n

According to the North Miami Beach Police Department, the alleged sexual battery happened at around 11:30 p.m. at the couple\u2019s apartment in the 13700 block of Northeast 20th Lane.<\/p>\n

The NMBPD report states that the victim, her friend and her friend\u2019s 53-year-old husband, Juan Jose Hernandez, had been drinking and dancing in the living room that night. The victim had been visiting the couple in South Florida for a little more than a week.<\/p>\n

Police said the victim fell asleep on the couch and Hernandez\u2019s wife went outside to smoke a cigarette. According to the report, Hernandez\u2019s wife came back and saw her husband raping her friend, \u201cimmediately yelled at (him) and physically pulled him away from the victim.\u201d<\/p>\n

The report states that the victim \u201cnever consented\u201d and awoke to her friend yelling and Hernandez raping her, saying she \u201cimmediately\u201d pushed him off.<\/p>\n

Police said Hernandez\u2019s wife quickly called the police on her husband.<\/p>\n

According to the report, Hernandez claimed that the victim had removed her pajama pants while dancing and pressed against him, but \u201cdenied engaging in sexual intercourse with the victim and denied that the victim was asleep at any point during the encounter.\u201d<\/p>\n

Officers arrested Hernandez on a sexual battery charge. As of Monday, his bond was listed as \u201cto be set\u201d in Miami-Dade jail records, pending an afternoon court appearance.<\/p>\n
